Privacy notification

In connection with your use of the Lundbeck LinkedIn channels, H. Lundbeck A/S will (as the data controller) collect, process, use and disclose personal data about you as described in more details in this Privacy Notification.

 

We will process your personal data according to applicable legislation, including the EU General Data Protection Regulation (“GDPR”).

What categories of personal data are we processing and for what purposes?

We collect and process the following types of personal data about you:

 

  • Aggregated personal data about you, i.e. age, sex, country, job title, job and education history and interests, provided that you make these types of personal data publicly visible on your LinkedIn profile.
  • Information you voluntarily provide us with in post on our LinkedIn channels or messages you sent us via LinkedIn message.

  • In case you report an adverse event or any product issue on our social media channels, we need to collect and process your name, location, health related information and contact information such as a phone number or email address. We require this personal data in order to report to our Pharmacovigilance Department and relevant health authorities. Please refer to our adverse event reporting policy.


We process your personal data for the following purpose:

  • For the purpose of understanding our audience’s demographic, preferences and interests, and being able to provide our audience with more relevant information and news via our social media accounts (profiling)
  • For the purpose of optimizing our audience and targeting. 
  • In case you report an adverse event or any product issue on our social media channels; we will process your personal data in order to collect and report relevant adverse events to the health authorities as set out in applicable pharmacovigilance legislation.


In addition to the above; by use of cookies, LinkedIn collects information on your interests and behaviour on LinkedIn. What is the legal basis for our processing of your personal data?

The legal basis for our collection and processing of your personal data via our LinkedIn channels, including via cookies, as set out above is the Art. 6(1)(f) of the GDPR (“the balancing of interest test”). Lundbeck’s legitimate interests is to conduct data analysis to create and optimizing our audience and targeting. 

 

The processing of personal data relating to one of our medicinal products will most often be processed due to applicable legislation regarding pharmaceutical products, e.g. for pharmacovigilance purposes (GDPR Art. 9 (2) (i)) in case you provide us with such information. In this case, we may process sensitive personal data about you.

How long will we store your personal data?

We store your personal data for as long as necessary to fulfil the purposes above, however, for no longer than 1.5 year after we have obtained it. In case of an adverse event or any product issue that you report to us on our social media, please refer to our adverse event policy.

Your rights

According to the GDPR, you have certain rights described below. Please note that limitations may apply to your ability to exercise these rights, for example, when your right to obtain the information is found to be overwritten by essential considerations of private interests. 

 

Right of access

 

You have the right to request access to the personal data Lundbeck processes about you.

Lundbeck must provide a copy of the personal data undergoing processing as a starting point free of charge or by electronic means, if the request has been submitted in a commonly used electronic form.

 

Right to rectification

 

You have the right to rectification of inaccurate personal data concerning you, including completion of incomplete personal data.

 

Right to erasure (right to be forgotten)

 

Under certain circumstances, you have the right to the erasure of the personal data concerning you.

 

Right to restriction

 

Under certain circumstances, you have the right to restrict Lundbeck's processing of personal data concerning you.

 

Right to data portability

 

Where processing is based on a consent or a contract and the processing is carried out by automated means, you have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format. You have the right to transmit this personal data to a third party without hindrance from Lundbeck, if technically possible.

Right to object

 

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on legitimate interests as legal basis for the processing (as set out in article 6(1)(f) of the GDPR and section 6 of the Danish Data Protection Act), including profiling based on this provision. Where you have exercised this right to object, Lundbeck must no longer process the personal data unless Lundbeck demonstrates compelling legitimate grounds for the processing, which override your interests, rights and freedoms, or if processing is necessary for the establishment, exercise or defence of legal claims.

Where your personal data are processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where you object to processing for direct marketing purposes, Lundbeck must no longer process the personal data for such purposes.

You also have the right to lodge a complaint with the competent supervisory authority, such as the Danish Data Protection Agency.
