Washington State Health Data Privacy Policy Addendum

This addendum to the Lundbeck Privacy Policy applies to personal health data collected from residents of Washington State and individuals whose personal health data is collected in Washington, in their capacity as “consumers” under the Washington State My Health My Data Act (the “MHMDA”). As used in this addendum, the terms “consumer” and “consumer health data” have the meanings ascribed to those terms in the MHMDA. 

Consumer Health Data Collection:

We may collect, use, and/or disclose the following categories of consumer health data:

 

Individual health conditions, treatment, diseases, or diagnosis;  

 

Social, psychological, behavioral, and medical interventions;   

 

Health-related surgeries or procedures;

 

Use or purchase of prescribed medication;

 

• Bodily functions, vital signs, symptoms, or measurements of the information described in this subsection;     

 

Diagnoses or diagnostic testing, treatment, or medication; 

 

Precise location information that could reasonably indicate a
consumer's attempt to acquire or receive health services or supplies;

 

Data that identifies a consumer seeking health care services; or  

 

Any information that a company, or their respective processor, processes to associate or identify a consumer with the data described above that is derived or extrapolated from nonhealth information (such as proxy, derivative, inferred, or emergent data by any means, including algorithms or machine learning).

Use of Your Consumer Health Data:

We collect and use consumer health data for the purposes described in the “Use of Your Information” section. Primarily, We collect and use consumer health data as necessary to provide products or services that the consumer to whom such consumer health data relates has requested. 

Sources of Consumer Health Data:

We collect consumer health data from the sources described in the “Information Collection” section. 

Our Sharing of Consumer Health Data:

We may share any of the consumer health data categories describe above. We do not share consumer health data other than to the extent necessary to provide our products or services that the consumer to whom such consumer health data relates has requested. 

Third Parties and Specific Affiliates With Whom We Share Consumer Health Data: 

As needed for the purposes described above, We share consumer health data with the following categories of third parties:


• Our affiliates. We may share consumer health data with Lundbeck affiliates worldwide that agree to treat it in accordance with this Privacy Policy.

 

• Our service providers. We may share consumer health data with service providers, agents, or contractors whom We use to support our business and who may also help Us maintain our Sites and provide administrative services to Us (e.g., Internet service providers, hosting companies, fulfillment services, order processing, providing customer service, maintaining and analyzing data, fulfillment of promotions, technical support, delivery services and financial institutions).  We seek to ensure that these unaffiliated parties will not use consumer health data for any purpose other than to provide the administrative services for which they are responsible. 

 

• Parties to a corporate transaction. We may share consumer health data as part of a sale, assignment, or other transfer of the business of these Sites, or any other corporate reorganization process, including mergers or acquisitions.

 

• Government agencies. We may disclose consumer health data to law enforcement or other government agencies in order to comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of the law or comply with legal process served on Us, protect and defend our rights or property or act in urgent circumstances to protect the personal safety of our end Users.

 

• Other third parties: In certain circumstances, We may need to provide data to other third parties to, e.g., comply with the law or protect Your rights. 

Exercising Your rights

If You are a consumer residing in Washington State, or a consumer whose consumer health data We collect in Washington State, subject to certain legal limitations and exceptions, You have the following rights with respect to consumer health data: 

 

• The right to confirm whether We are collecting, sharing, or selling Your consumer health data and to access such data, including a list of all third parties and affiliates with whom We have shared or sold the consumer health data and an active email address or other online mechanism that You may use to contact these third parties; 

 

The right to withdraw consent from our collection and sharing of Your consumer health data; and    

 

The right to have Your consumer health data deleted.

 

If You would like to exercise Your rights pursuant to the MHMDA, please submit a verifiable consumer request to Us by either:

You may make a request on Your own behalf, and if You are the parent or guardian of a minor child, You also may make a request related to Your child’s consumer health data.  If You wish to designate an authorized agent to make a request on Your behalf, please provide Us with a signed declaration stating that Your intent is to permit that individual to act on Your behalf and include such individual’s full name, address, email address, and phone number.  That way we will be sure You have fully authorized Us to act in accordance with the requests of that individual.

 

As indicated above, in order to protect Your consumer health data from unauthorized disclosure or deletion at the request of someone other than You or Your legal representative, We require identification verification before granting any request to access, withdraw consent, or delete Your consumer health data. We take special precautions to help ensure this.  We cannot respond to Your request or provide You with consumer health data if we cannot verify Your identity or authority to make the request and confirm that the consumer health data relates to you.   We will only use consumer health data collected in connection with a verifiable consumer request to verify the requestor's identity or authority to make the request.

 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 45 additional days), we will inform You of the reason and extension period in writing.

 

If Your request to exercise a right under the MHMDA is denied, You may appeal that decision by contacting our privacy support team via our web form. If Your appeal is unsuccessful, You can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint
